The matter was approached with particular consideration of Section 489-F of the Pakistan Penal Code, 1860, relating to dishonestly issuing a cheque towards repayment of a loan or fulfilment of an obligation where the cheque is dishonoured. Depending upon the facts and evidence, other provisions relating to cheating, fraud, and dishonest inducement were also examined.

Challenge

The principal legal issue was to determine whether the facts and available evidence disclosed the ingredients of the alleged offences and whether the conduct complained of attracted criminal liability in addition to any underlying civil or contractual dispute.

Particular attention was given to:

  • Issuance and dishonour of the cheque;
  • The purpose and consideration for which the cheque was issued;
  • The existence of the underlying financial obligation;
  • Documentary and transactional evidence;
  • The intention and conduct of the parties;
  • The applicability of Section 489-F PPC; and
  • Whether the facts disclosed the ingredients of any additional offence relating to cheating or fraud.

Our Process

1. Examination of the Transaction

We examined the underlying financial transaction, agreements, payment records, cheque, bank return memo, correspondence, and other supporting documents.

2. Criminal-Law Assessment

The facts were analyzed against the ingredients of the relevant offences, particularly Section 489-F PPC and other provisions that may be attracted depending upon the evidence.

3. Preparation of Criminal Complaint

The available evidence was organized chronologically and the relevant facts and legal grounds were incorporated into the criminal complaint/application before the competent authority.

4. Police & Court Proceedings

Bangash & Co. represented the client in proceedings before the relevant police authorities and assisted with subsequent criminal proceedings before the competent court, as applicable.

Result

Bangash & Co. developed and pursued a focused criminal-law strategy based on the documentary and transactional evidence. The matter demonstrates the firm’s experience in handling cheque dishonour, financial fraud allegations, criminal complaints, and proceedings arising from disputed financial transactions.

The firm approaches such matters by carefully distinguishing between a purely civil dispute and circumstances that may independently constitute a criminal offence under the applicable law.
